Your agreement confirms that you have understood and accepted all conditions. Your safety and satisfaction are important to us. We look forward to supporting you with your tattoo project.

1. Scope of the Terms and Conditions

The following General Terms and Conditions (hereinafter referred to as “Terms”) apply to all legal transactions and services, in particular tattooing, provided by Holy Nail Tattoo as the contracting party, either directly or through its employees or subcontractors.

All agreements made between the client and the contractor regarding the provision of services must be made in writing. 

Amendments, additions, deviations, and side agreements require a separate written agreement to be valid and do not affect these Terms and Conditions.

2. Provision of services

The contractor undertakes to perform the tattooing service diligently and professionally in accordance with the commonly accepted industry standards. 

Before the service is performed, the client will receive a detailed consultation and information about possible risks, especially the risk of allergic or inflammatory skin reactions.

Services provided by the contractor will only be performed if the following conditions are met—without prejudice to the other provisions of these Terms and Conditions.

  • The client has reached the age of 18. To verify age, the presentation of a valid official photo ID is mandatory.
  • The client appears at the agreed appointment sober, without influence of alcohol, narcotics, or other intoxicating substances.
  • The client is not pregnant.
  • There are no known allergies or intolerances to the ingredients of the tattoo inks or other materials used.
  • The client does not take any medication that significantly complicates or contraindicates tattooing, especially no blood-thinning agents.
  • The client does not suffer from any conditions that contraindicate tattooing, especially not HIV, hepatitis, epilepsy, or similar illnesses.
  • The skin areas to be tattooed are clean and free of skin diseases or injuries on the day of the appointment.
  • The desired tattoo design contains no political, discriminatory, offensive, immoral, or ethically unacceptable content.
  • On the day of the service, there are no health or other conditions that make performing the tattoo impossible or irresponsible.
  • No unauthorized topical anesthetics have been applied.
  • The client is mentally and age-wise capable of fully understanding the scope and significance of the tattooing service.

3. Rights and Obligations Within and Beyond the Terms and Conditions

The client is obligated to inform the contractor comprehensively and truthfully about all circumstances relevant to the performance of the tattooing service before it begins.

The client must promptly and fully inform the contractor if one or more of the following conditions apply:

  • Known allergies, especially to ingredients of the tattoo ink or other materials used for the tattoo.
  • Use of medication, especially blood-thinning or other drugs that may significantly complicate or contraindicate tattooing.
  • Existing illnesses or health impairments that may be relevant to the service, especially HIV, hepatitis, epilepsy, or similar conditions.

The client is obligated to promptly inform the contractor of any changes or the emergence of the aforementioned circumstances before or during the service. If the client fails to fulfill this duty to inform, either fully or at all, they shall be liable for all resulting damages and consequences, provided these are based on omitted or incorrect information.

The contractor reserves the right to refuse, interrupt, or terminate the service in whole or in part in case of incomplete or incorrect information.

Furthermore, the client agrees to follow the aftercare instructions personally provided by the contractor, as well as any other hygiene and care guidelines issued by the contractor, until the tattoo has fully healed. 

In addition to the verbal clarification provided during the consultation and information session, the client also agrees to take into account the information available on the website www.holynailtattoo.com or www.holynailtattoo.de as well as the information displayed in the business premises.

4. Prices, terms of payment, due date, down payment, flat-rate damages

Tattoos.

Prices are calculated based on effort and individual agreement. The prices include a consultation/information session, the creation of the design, the tattooing process, as well as any necessary touch-up work, taking into account. Ziffer 7.

The prices mentioned during initial consultations are non-binding and represent a rough estimate, unless a fixed price has been agreed upon in writing beforehand. Fixed prices can only be agreed upon with the contractor or a representative appointed by them.

Factors that become known shortly before, during, or after the tattooing (e.g., skin reactions or the client's pain tolerance) will be taken into account when determining the price.

For larger projects with multiple follow-up appointments, a maximum fixed price per appointment will be agreed upon; no overall price for all appointments will be set.

If the tattoo is changed at the client's request after the service has begun, a new price agreement between the client and the contractor is required.

Other Services.

The prices for other services are based on the marked prices or the currently valid price list. The prices include sales tax. Payments are always due immediately and without deduction.

5. Deposit, Flat-Rate Compensation for Tattoos

For binding appointment bookings for a tattoo, a deposit based on the expected total effort, but at least EUR 50.00 (gross), is due immediately and without deduction.  

The deposit will be credited towards the final price. For appointments with follow-up sessions, the deposit will be offset against the final payment at the last appointment. The deposit will be retained if the appointment is not canceled at least three working days before the agreed date. This also applies if the appointment card cannot be presented during the scheduled appointment.

Cancellations must be made by phone or by email to cancellation@holynailtattoo.com.

In the case of an appointment with follow-up sessions, the contractor reserves the right to invoice a partial amount for the service after each appointment.

In case of a late cancellation (48 hours or two working days before the agreed appointment) or no-show, the contractor may, in addition to legal claims, demand flat-rate compensation amounting to the deposit paid according to Section 4, Paragraph 4 and offset it against the deposit.

The contractor reserves the right to prove a higher damage. The client reserves the right to prove that no damage or only minor damage has occurred.

In the case of a cancellation before the aforementioned period, the contractor reserves the right to retain the full amount of the deposit as compensation if a complex custom design has been created.

In the event of a refund, the deposit will not be reimbursed in cash but issued to the client in the form of a voucher. Section 6 applies to vouchers.

6. Vouchers

Vouchers can be purchased for the provision of services. Only one voucher can be redeemed per service. Vouchers are not paid out, not even partial amounts. The voucher is valid for 12 months.

A voucher does not guarantee the tattooing of any design. Even with vouchers, the contractor reserves the rights mentioned above.

7. Touch-up Work

Prices for tattoos include touch-up work. Touch-up work refers to necessary adjustments within the usual scope after the tattoo has healed. Whether touch-up work is necessary depends individually on the client, particularly on their skin characteristics and/or the skin's ability to absorb pigment.

Appointments for follow-up work must be made within 6 to 8 weeks of the last day of service provision, otherwise the follow-up work is subject to separate payment.

If the agreed appointment for touch-up work is missed by the client without a valid reason and/or without timely cancellation (48 hours or two working days before the agreed appointment), the entitlement to free touch-up work expires.

Touch-up work based on defective performance by the contractor is free of charge as part of the subsequent fulfillment.

Touch-up work that becomes necessary due to improper care by the client and thus due to a violation of Section 3 is subject to separate payment.

8. Cover-ups

Cover-ups refer to tattoos that, at the client's request, partially or fully cover or redesign an existing tattoo of the client.

A complete coverage of the original tattoo by the contractor cannot be guaranteed in the case of cover-ups.

The contractor expressly points out that interactions may occur between the existing tattoo ink and the newly applied tattoo ink, especially due to aesthetically undesired color changes or unforeseeable skin irritations.

Cover-ups may require more time than originally anticipated. The additional effort incurred must be borne by the client according to the agreed hourly rate. The contractor will inform the client in a timely manner about the increased time required.

Touch-up work as defined in Section 7 is always subject to separate payment for cover-ups. This does not apply in the case of Section 7, Paragraph 4.

9. Ownership and Copyright

The client grants the contractor a free, unlimited usage, reproduction, and publication right —unrestricted in content, location, and time — for selected photographs. These photographs are taken of the completed tattoo — especially also during the tattooing process — in coordination with the client.

Ownership and copyright of design templates, as well as individual draft sketches or preliminary drawings, remain with the contractor. The contractor expressly reserves the right to reuse the templates multiple times.

10. Consent Declaration Within the Scope of the Terms and Conditions

The client expressly consents to the procedure they have requested and agreed upon, as well as to the resulting violation of physical integrity in accordance with Section 223 (1) in conjunction with Section 228 of the German Criminal Code (StGB).

The tattoo is done at the client's own request and with full knowledge of the nature, scope, and possible risks of the procedure. Consent is given voluntarily and after comprehensive clarification by the contractor.

A subsequent revocation of this consent is generally excluded after the commencement of the service, unless compelling legal reasons prevent this.

11. Final Provisions of the Terms and Conditions

If any provision of these Terms and Conditions is or becomes wholly or partially invalid, impracticable, or unenforceable, the validity of the remaining provisions shall remain unaffected.

In place of the invalid, impracticable, or unenforceable provision, a regulation shall be deemed agreed upon that comes closest to the economic purpose of the original provision in a legally permissible manner.

This applies accordingly to any unintentional regulatory gaps.
