You are welcome to fill out the following consent form in advance and bring a printed version with you to your appointment. If you do not have access to a printer, you can also send the consent form by email as an attachment to appointment@holynailtattoo.com – stating your name and your appointment.
Is all this bureaucracy even necessary?
To make you aware of why a consent form and all the paperwork is generally mandatory, it should be said that although tattoos are a popular form of body art and modification, from a legal point of view they fall under the definition of bodily harm in Germany.
Without your consent, applying a tattoo could be considered bodily harm according to § 223 StGB. This is because your skin is injured by the introduction of ink with needles. In this context, it is important that you understand the legal aspects and requirements for a legally flawless implementation.
Your consent is therefore the most important legal protection for the tattoo artist. In order for a tattoo not to be considered bodily harm, you must voluntarily and explicitly consent under the following conditions:
- Legal capacityIn Germany, people aged 18 and over are considered to be legally competent and can independently give legally binding consent. For minors, the consent of a parent or legal guardian is required. However, this is excluded at Holy Nail Tattoo according to Section 5 Paragraph 1 of the General Terms and Conditions .
- Duty to informHoly Nail Tattoo has a comprehensive duty to inform. You must be informed about the type of tattoo, the procedure, the possible risks and the care instructions. Only if you know and understand this information can this consent be considered valid and legally effective.
- DocumentationThe consent should be documented in writing and signed by you.
